The Service

Creative CRM provides tools for managing contacts, leads, and communications. We may add, change, or remove features as the Service evolves.

Your Account

You are responsible for the accuracy of the information you provide and for maintaining the security of your account credentials. You must be at least 18 years old to use the Service.

Acceptable Use

You agree to use the Service in compliance with applicable laws, including laws governing electronic communications (such as the TCPA and CAN-SPAM Act). You may only send messages through the Service to recipients who have given appropriate consent, and you may not use the Service to send unlawful, deceptive, or abusive content.

When you call, text, or email people through the Service, you are the sender and are responsible for complying with the laws that apply to you and to the people you contact. That includes, as applicable: holding your own National Do Not Call Registry subscription and any required state Do Not Call lists, and checking numbers against them before calling; calling only during the hours allowed where the recipient is; registering as a telemarketer in any state that requires it; leaving pre-recorded voicemail messages only for people who have given prior express written consent; identifying your business (and, for licensed real estate professionals, your brokerage) as the law requires; and following any state laws that govern contacting homeowners about foreclosure or distressed property.

Property and owner information obtained through the Service's lead-generation features is provided for marketing your own real estate services. You may not use it to decide anyone's eligibility for credit, insurance, employment, or housing (including tenant screening), or for any other purpose covered by the Fair Credit Reporting Act, and you may not use the Service to target or exclude people on any basis prohibited by fair housing laws.

Where the Service Is Offered

The Service is offered only in the United States. You may use its email, text, calling, and voicemail features only to contact people in the United States.

Text Messaging (SMS) Terms

By entering your phone number at www.creativecrm.app/sms-opt-in and checking a consent box there, you consent to receive recurring text messages from Sitting Pretty Creative LLC (Creative CRM) in the categories you selected. Account and customer service texts include account notifications, service alerts, and replies to your support requests. Marketing and promotional texts include offers, promotions, product announcements, and event invitations. The two are separate consents; checking one never enrolls you in the other. After you opt in, we send one text confirming your sign-up. You must be at least 18 years old to opt in. Consent is not a condition of any purchase or of creating an account. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out, or HELP for help. Mobile carriers are not liable for delayed or undelivered messages. Our handling of your phone number and messaging consent is described in our Privacy Policy; we do not share mobile information or messaging consent with third parties or affiliates for marketing or promotional purposes.

Your Data

You retain ownership of the data you store in the Service. You grant us the limited rights needed to host, process, and display that data in order to provide the Service. Our collection and use of personal information is described in our Privacy Policy.

To provide support or investigate a problem, our platform administrators may access your account and act within it. Every such session, and every change made during it, is logged. Support staff cannot see the contents of a Gmail or Microsoft mailbox you have connected.

Copyright Complaints

We respect intellectual property rights. If you believe material stored in or sent through the Service infringes your copyright, email us at info@sittingprettycreative.com (subject: "Copyright Complaint"), and include: your physical or electronic signature; a description of the copyrighted work; a description of the material and where it appears in the Service; your address, phone number, and email; a statement that you believe in good faith the use is not authorized by the copyright owner, its agent, or the law; and a statement, under penalty of perjury, that your notice is accurate and that you are the copyright owner or are authorized to act for the owner.

If material you posted was removed and you believe that was a mistake, tell us at the same address and explain why. We will remove material we find to be infringing and will terminate, in appropriate circumstances, the accounts of users who repeatedly infringe.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted or error-free.

Limitation of Liability

To the maximum extent permitted by law, Sitting Pretty Creative LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Termination

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms or applicable law. When an account is deleted, its data stays recoverable for 45 days and is then permanently deleted, as described in our Privacy Policy. Download a copy of anything you want to keep before then.

Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Service will be brought in the state or federal courts located in New York.

Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page with a revised effective date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
